The Seller is not bound by any codes of conduct within the meaning of § 1820(1)(n) of the Civil Code.

Scope, parties, and definitions

These Terms govern purchases by consumers (as defined in § 419 of Act No. 89/2012 Coll., the Civil Code) from the Seller via the E‑shop. They do not apply to B2B purchases.
Goods: products offered on the E‑shop (primarily tea and related goods) with key characteristics, price, availability, and any discounts displayed on the product page.
Contract: a distance contract concluded between the Seller and the consumer via the E‑shop.

Pre‑contract information and contract formation

Language: The Contract may be concluded in Czech or English. The governing language for interpretation is Czech if a Czech version is published.
Ordering steps: select Goods, add to cart, enter delivery and billing details, choose delivery and payment method, review the order, and submit by clicking “Order with obligation to pay.”
Correction of input errors: you can change or correct entered data at any time before submitting the order using the E‑shop’s on‑screen fields.
Contract conclusion: after submitting the order, you will receive an e‑mail confirmation of receipt. The Contract is concluded when you receive an explicit order acceptance/dispatch confirmation.
Archiving: The Contract (including these Terms) is stored electronically by the Seller and is not routinely accessible to the consumer. You may request a copy by e‑mail.
Means of communication: No additional costs are charged beyond your basic internet/phone tariff.
Not a marketplace: The E‑shop sells products offered by the Seller; it is not an online marketplace.

Prices, discounts, and payment

Prices are stated in CZK, including VAT and all applicable taxes and fees. Any delivery costs are shown during checkout and added to the total before you submit the order.
Omnibus price-reduction rule: When a discount is shown, the E‑shop displays the lowest price of the product in the 30 days prior to the discount.
Payment methods:

  • Online card payment via our payment gateway.
  • Bank transfer (advance payment) to the Seller’s bank account (details provided at checkout and by e‑mail).
  • Other instant methods offered by the payment gateway (e.g., Apple Pay/Google Pay), if available on the E‑shop.
  • Cash on Delivery is not available.

Payment due:

  • Online card/payment gateway: payable at checkout.
  • Bank transfer: payable within [3–5] business days of order confirmation; the order may be canceled if unpaid after the due date.

Retention of title: Ownership passes to you only upon full payment. Risk of damage passes upon physical handover (see section 6).

Delivery

Delivery areas: We deliver within the Czech Republic and to other countries listed at checkout. We do not unjustifiably discriminate by nationality or residence (EU Geo‑blocking Regulation).
Dispatch times: Items marked “in stock” are typically dispatched within 2 business days; otherwise within 5 business days, unless stated differently on the product page. These are estimates; we will inform you of delays.
Delivery time: Usually 3–7 business days domestically; international times vary by carrier and destination.
Delivery costs: Shown during checkout based on carrier, weight, and destination.
Risk and inspection: Risk of damage passes on your receipt from the carrier. Please check the parcel on delivery; if visibly damaged, either refuse it or note the damage with the carrier and contact us promptly.
Undeliverable/second delivery: If a parcel is returned due to an incorrect address or failure to collect, we can re‑ship after your confirmation; you may be charged actual re‑delivery costs.

Right of withdrawal (returns)

Statutory right: You may withdraw from the Contract within 14 days from the day you or a third party (other than the carrier) takes delivery of the Goods (Civil Code § 1829).
How to withdraw: Notify us by e‑mail at tea@ya-cha.eu within the 14‑day period. You may use the model form in Annex A, but it’s not mandatory.
Return of Goods: Send the Goods back within 14 days from your notice of withdrawal to:

Costs of return: You bear the direct costs of returning the Goods.
Refunds: We will refund the price paid for the Goods and the cost of the least expensive offered delivery option without undue delay, no later than 14 days from your withdrawal notice. We may withhold the refund until we receive the Goods or you provide proof of sending them back, whichever occurs first. Refunds are made by the same payment method unless agreed otherwise.
Diminished value: You are liable for any diminished value of the Goods resulting from handling beyond what is necessary to establish their nature, characteristics, and functioning.
Legal exceptions (Civil Code § 1837):

  • Sealed goods which are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery (e.g., opened packs of tea) cannot be returned.
  • Goods liable to deteriorate or expire rapidly are also excluded.
  • These exceptions do not prevent return of unopened, intact, sealed tea products.

Defects and complaints (rights from defective performance)

Conformity: The Seller is liable that the Goods conform to the Contract upon delivery. Conformity includes described quality, quantity, functionality, compatibility, durability, and other features reasonably expected.
Period to assert defects: You may assert a lack of conformity that becomes apparent within 24 months from delivery. For the first 12 months, it is presumed the defect existed at delivery unless proved otherwise.
Remedies: You may request repair or replacement. Only if repair or replacement is impossible or disproportionate, or not provided within a reasonable time or without significant inconvenience, you may request a reasonable price reduction or withdraw from the Contract.
Wear and misuse: Liability does not cover normal wear and tear, damage caused by improper use, storage contrary to instructions, or failure to follow care guidelines.
How to complain: E‑mail tea@ya-cha.eu with your order number, description of the defect, and photos if possible. We will instruct you on returning the item if needed.
Handling time: We decide without undue delay; in complex cases within 3 business days (excluding the time needed for expert assessment). Complaints are resolved without undue delay, no later than 30 days from submission, unless we agree a longer period with you. If not resolved within 30 days, you may withdraw or request replacement.
Costs: If your complaint is justified, we will reimburse your reasonable postage costs; keep your receipt.

Commercial communications, reviews, and transparency

Newsletters: We send commercial communications by e‑mail in accordance with Act No. 480/2004 Coll. You can unsubscribe at any time via the link in each e‑mail or by contacting us.
Reviews authenticity: If we display product reviews, we indicate whether and how we verify that reviews originate from real customers (e.g., inviting reviews only from completed orders and marking such reviews).
Ranking transparency: When search results or product listings are ranked, the main parameters are relevance to the search query, product availability, popularity/sales, and price. We do not use paid placements unless clearly labeled.
Personalized pricing: We do not use personalized pricing based solely on automated decision‑making. If we ever do, we will clearly inform you.

Personal data and cookies

We process personal data in line with GDPR (EU) 2016/679 and Czech law. See our Privacy Policy and Cookie Policy available on the E‑shop for details about purposes, legal bases, retention, recipients (carriers, payment providers, platform providers), and your rights.

Out‑of‑court dispute resolution and supervision

If you are not satisfied with how we handled your complaint, you may contact:

Supervision of consumer protection: Czech Trade Inspection Authority.
You may also contact your local consumer organization for advice.

Final provisions

Governing law: Czech law applies. If the Contract contains an international element, mandatory consumer protections of your country of residence may also apply.
Changes to Terms: We may update these Terms. The version effective at the time you place an order governs that order. We publish the current Terms on the E‑shop with the effective date.
Severability: If any provision is invalid or ineffective, the closest valid provision applies; the rest remain in force.
Language versions: If we publish these Terms in multiple languages, the Czech version prevails in case of discrepancies.
Assignment: We may assign rights/obligations only in accordance with applicable law and without reducing your statutory rights.
